1. About these terms

These are the terms of service for Kookabytes, operated by Mindset Cyber Pty Ltd (ABN to be issued). By creating a school account or subscribing, the school agrees to these terms.

Your school administrator is the contracting party. Individual teachers and students use the service under that account.

2. The trial period

Every new school gets 30 days of free access. No credit card is required to start. We will email reminders before the trial ends.

If you choose not to continue, your dashboard becomes read-only for 60 days so you can export anything you need before deletion.

3. Subscription, billing & GST

Schools are billed annually for active students. An active student is one who has logged in at least once in the licence year. Retired and graduated students do not count.

Prices on the pricing page are in Australian dollars and exclude GST. GST is added at checkout and shown on your tax invoice.

Schools may pay by card or by invoice (purchase order). Invoiced accounts must be paid within 30 days of invoice date.

4. Acceptable use

The service is intended for use inside Australian primary schools. Resale, sub-licensing, scraping, or use to build a competing product is not permitted.

Schools agree not to upload personal information about students beyond what the product requires (first name and class).

5. Service availability

We aim for 99.5% monthly availability outside scheduled maintenance.

Scheduled maintenance windows will be communicated in advance and are typically outside Australian school hours.

6. Intellectual property

All episodes, characters, music, code, and assets remain the property of Mindset Cyber Pty Ltd and its licensors.

Schools receive a non-exclusive, non-transferable licence to use the service for the term of their subscription.

7. Liability

Nothing in these terms excludes the consumer guarantees in the Australian Consumer Law that cannot be excluded.

Subject to the above, our aggregate liability for any claim is capped at the fees paid by the school in the twelve months preceding the claim.

8. Termination

Either party may terminate by giving 30 days written notice. Schools that pre-paid for an annual term receive a pro-rata refund for unused months.

We may suspend or terminate immediately for serious breach of these terms or where required by law.

9. Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.

10. Updates to these terms

This is a placeholder draft. The final version will be reviewed by Australian counsel before launch and will replace this page in full.

We will email school administrators 30 days before any material change takes effect.
